1. Overview of Data Protection

This privacy policy explains how your personal information is handled when you engage with our services or visit our website. "Personal information" refers to any data that can identify you directly or indirectly.

2. About DBT in Mind Limited

DBT in Mind Limited specialises in Dialectical Behaviour Therapy (DBT) and Mentalization-Based Therapy (MBT) programmes to support people navigating challenges with emotional regulation and complex relationship dynamics, including those who have received diagnoses such as BPD/EUPD, ADHD, or complex trauma.

DBT in Mind Limited provides services via a team of professionals who are independent, self-employed therapists (contractors). These therapists work with clients under the DBT in Mind umbrella and are not employees. They are individually responsible for their clinical decisions, professional standards, and the handling of therapy records.

3. Information We Collect and How It Is Used

When you make an enquiry or begin working with us, we collect basic information (such as name, contact details and referral reasons) for administrative purposes such as arranging sessions, invoicing or matching you with a therapist. This administrative data is managed by DBT in Mind Limited.

Once you begin therapy, your therapist may collect and store sensitive personal information (e.g. assessments, therapy notes, clinical history). Your allocated therapist is the sole data controller for this clinical information and is independently responsible for storing and safeguarding it in line with their professional, legal and ethical standards.

4. Your Rights

You have rights under the UK GDPR including:

  • The right to access the personal data held about you
  • The right to request corrections or deletions
  • The right to request transfer of your data to another provider

For administrative data (e.g. contact information or invoices), you may contact DBT in Mind Limited.

For clinical or therapy records, you should contact your individual therapist directly, as they are responsible for those records.

We do not offer expert witness services for court proceedings.

You also have the right to lodge a complaint with the UK Information Commissioner's Office (ICO) if you believe your data has been mishandled.

5. Data Retention

Therapists retain clinical data in accordance with their professional obligations, typically for six years after therapy ends (or longer if required). DBT in Mind Limited retains administrative data only as long as necessary to support service provision and comply with legal requirements, including indemnity insurance.

6. Data Sharing

We will only share your information with third parties with your explicit consent, unless required by law (e.g. to protect safety or comply with legal duties). When shared, data will be transmitted securely.

7. Data Security

DBT in Mind Limited, as well as individual therapists working under the DBT in Mind brand, take appropriate technical and organisational measures to keep your information secure.

8. Lawful Basis for Processing

DBT in Mind Limited processes your administrative data under the lawful basis of contract and legitimate interest. Your therapist processes clinical data under their contract with you as a health professional and according to the requirements of their professional body (e.g. BACP, UKCP, HCPC, etc.).
